Civil Litigation and Dispute Resolution
General disputes involving individuals, businesses, governments or other entities can often be resolved without recourse to the courts. Sometimes, however, commencing a civil action and going to trial are necessary. We have extensive experience resolving civil disputes through negotiation, mediation, arbitration and trial. We have acted in all levels of court in BC, in matters involving a wide range of issues, and for a variety of clients.
Constitutional and Public Interest Law
The Constitution and Charter of Rights and Freedoms are the supreme laws in Canada, and they protect our most basic and fundamental rights. We have a special interest in constitutional and public interest legal issues and have been involved in cases involving freedom of expression, the right to life, liberty and security of the person, freedom from unreasonable search and seizure, freedom from arbitrary detention or imprisonment, and the right to equal treatment before and under the law, among other issues.
Administrative law is the body of law that addresses the actions and operations of governments and governmental agencies. We act for clients before various tribunals and administrative bodies including the Office of the Police Complaints Commissioner, the BC Coroner's Service, the Human Rights Tribunal, the Workers Compensation Appeal Tribunal, and the Residential Tenancy Board. As well, we have been counsel at two public inquiries: the Davies Commission into the Death of Frank Paul and the Missing Women Commission of Inquiry. Contested administrative decisions may involve injunction applications and contempt of court proceedings.
Personal Injury Law
We have extensive experience acting as counsel for individuals who have been injured as a result of the intentional or negligent conduct of others. We act for individuals with all manner of serious injuries including brain injury, spinal chord injury, chronic pain, and psychiatric injuries. We work closely with doctors and other experts to present claims in the best light possible. We have a special interest in civil claims against police for assault and battery, and wrongful death claims brought under the Family Compensation Act. We have handled numerous cases arising out of motor vehicle accidents involving ICBC and other insurance companies.
Employment and Human Rights Law
We have acted for employees and employers in numerous wrongful dismissal and human rights cases. We provide advice on employment contracts, dismissal for cause, severance, fiduciary duties, non-competition and non-solicitation agreements, and constructive dismissal. We also advise small and mid-sized businesses on best practices to avoid employment disputes.
